- Institutionalization for mental illness

Once you serve your spouse divorce papers, you will have to attend the Case Management Conference, where the judge will analyze all divorce-related matters as they pertain to your case and will determine whether the process should be expedited or not. The judge will address the following issues in the Case Management Conference:
- The contested issues present in your divorce
- The pre-trial discovery process
- A potential Early Settlement Panel date
- A selection of expert witnesses
- Whether child custody or parenting time are disputed
The Early Settlement Panel in New Jersey
If you and your spouse cannot resolve your initial disputes on your own, your case will be referred to an Early Settlement Panel, which is essentially a Panel composed of several attorneys who will try and resolve any contested issues within your divorce. If you and your spouse do not accept those recommendations, you may either try to settle your divorce through mediation or through litigation.
Final Judgment of Divorce in New Jersey
After litigating your divorce, the court will execute a Final Judgment of Divorce. You should note that if the divorce matter was litigated, you or your spouse will have the right to appeal the Final Judgment.
Enforcement of Final Judgment of Divorce
Any failure to abide by the terms of a divorce decree may potentially result in the violating spouse being held in contempt of court. The violation may relate to a failure to pay a debt, alimony or spousal support, child custody, child support, or any other term contained in the decree.
Modification of Final Judgment of Divorce
When a change in circumstances of either spouse calls for a change in alimony, child support, child custody, or parenting time, a post-judgment application can be filed by one or both former spouses requesting the court modify part(s) of the final divorce judgment.
