A presumption of incarceration applies in these cases.
- First-degree indictable offense (felony). The actual creation of child pornography—or allowing a child to engage in child pornography—may be punished as a first-degree crime carrying a New Jersey State Prison (NJSP) Sentence of 10 to 20 years and a fine of $200,000. A presumption of incarceration applies in these cases.
