Knowing possession or viewing of Child Sexual Exploitation/Abuse Material (Child Pornography) is a third-degree crime under New Jersey law based upon the number of possessed images.  Distribution or sharing of Child Sexual Exploitation/Abuse Material (Child Pornography) is a second-degree charge in most circumstances.   

Child pornography charges can be prosecuted as: 

Third-degree indictable offense (felony).  Mere possession of child pornography, without more, is punishable as a third-degree crime in New Jersey, meaning that you will face up to five years in jail if convicted (and jail time will be mandatory if more than 100 but less than 1000 images are involved). N.J.S.A. 2C:24-4b(5)(B)(iii). There is a maximum sentence of five (5) years in New Jersey State Prison with a presumption of incarceration for the number of items (more than 100 and less than 1000) of child sexual exploitation/abuse material recovered.

  • Second-degree indictable offense (felony). Distributing Child Sexual Exploitation/Abuse Material (Child Pornography) is a second-degree offense, meaning that you will face between five and ten years in jail if convicted and a fine of $150,000. A presumption of incarceration applies in these cases. 
  • First-degree indictable offense (felony).  The actual creation of child pornography—or allowing a child to engage in child pornography—may be punished as a first-degree crime carrying a New Jersey State Prison (NJSP) Sentence of 10 to 20 years and a fine of $200,000. A presumption of incarceration applies in these cases.

A conviction for Possession, Distribution of Child Sexual Exploitation/Abuse Material (Child Pornography) subjects the defendant to the following:

  • Parole Supervision for Life (PSL), 
  • Sex offender treatment at the Adult Diagnostic and Treatment Center (ADTC) located in Avenel, NJ, 
  • The Adult Diagnostic and Treatment Center is a secure correctional facility operated by the New Jersey Department of Corrections. Its purpose is to provide treatment and incarceration for certain criteria meeting repetitive and compulsive male sex offenders who have been sentenced under the New Jersey Sex Offender Act. The defendant will be required to undergo a psychosexual/Avenel evaluation.
  • Sex offender registration requirements under Megan’s Law.
